Qualified Teacher Status and Work Permit Applications for Teachers

This is a reminder of the statutory provisions relating to the employment of Overseas Trained Teachers (OTTs).

OTTs may teach in maintained schools and non-maintained special schools in England (other than pupil referral units) for a period of up to four years, provided they have successfully completed a programme of professional training for teachers in a country outside the UK which is recognised by the competent authority in that country. To continue teaching beyond this period, the OTT must have obtained Qualified Teacher Status (QTS).

The four-year period commences on the day the OTT first works as a teacher in England and expires four years later, regardless of any breaks in teaching and irrespective of his/her immigration status.

These provisions are not set out by the work permit arrangements; they are contained in the 'Education (Specified Work and Registration) (England) Regulations 2003'. The provisions apply to OTTs who do not require work permits as well as to those who do. Work permits for teachers without QTS are issued for limited periods in line with these regulations. Work Permits (UK) does not have authority to waive the regulations or issue work permits for teachers to work in breach of the provisions.

At present, OTTs may continue teaching after their four year period has expired if they are undertaking an employment-based teacher training scheme (the Overseas Trained Teacher Programme or the Graduate Teacher Programme) at the end of their four year period, with a view to obtaining QTS.

In such cases, all applications for work permit extensions beyond the four-year period must be accompanied by a standard letter from the training provider responsible for the OTT's training scheme. This must confirm that the OTT was already undertaking an employment-based teacher training scheme before the expiry of their four year period, and also provide details of the course start and end dates.

If an OTT is not already undertaking an employment-based teacher training scheme when their four year period expires, they will need to cease teaching and obtain QTS via an undergraduate or postgraduate route before they can teach in England again.

From August 2007, changes are planned to the 'Education (Specified Work and Registration) (England) Regulations 2003', so that it will no longer be possible for OTTs without QTS to continue teaching after four years under these or any other circumstances.

Therefore, it is strongly recommended that employers urge OTTs to obtain QTS within their four year period if they wish to carry on teaching after that, and if necessary to join the Overseas Trained Teacher Programme well before their four-year period ends.
